Human rights commissioner for the Russian Federation: People with disabilities cannot be placed in penitentiary facilities

The Russian Ombudsman Tatiana Moskalkova is prepared to discuss with Duma Deputies the reasons why sick and disabled people could be released from serving out their sentences in penal colonies and prisons.

As Interfax reports (with reference to Moskalkova), more than 100 applications have been made to the Commissioner’s Office regarding sentences of people with oncological diseases, and with advanced diabetes.

«I propose that the State Duma amend the wording of the text of the law from ˜the court has the right» to ˜the court is obliged», said Moskalkova on Friday at a meeting with young lawyers.

She gave the example of the recent case of Anton Mamayev, who was convicted of robbery, and suffers from a group 1 disability.

«I believe that he is unable to serve out his sentence in such conditions, because it would amount to his murder», the Commissioner remarked. «He must be placed at home.»

It has previously been announced that the Presidential Committee of the Russian Federation for the Development of Civil Society and Human Rights was calling for the imminent release of 28-year-old Anton Mamayev. On Wednesday 19 July, it became known that Anton Mamayev, who has a group 1 disability, was sentenced to four and a half years in a penal colony for robbery, and released from custody; he will not serve out his sentence even if the appeal court upholds the sentence. His illness is included in the government decree stipulating which groups of people cannot serve prison sentences.
